Welcome to booquet! booquet.com is a website (the "Site") that allows you to find the wine you love through its unique array of content and tools, content aggregation services and social networking functionality (collectively, the "Services", which includes the Site, mobile versions of the Site, mobile applications derived from the site and downloadable applications). booquet, LLC (the "We", "Us" or "Company"), the operator booquet, is committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the information we collect from you on the Site and Services. By using the Services, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your information in accordance with this Privacy Policy.
1. INFORMATION COLLECTION AND USE.
As a general rule, we collect personal and non-personal information to fulfill your requests for services, authenticate you when you log in, improve our services, and to contact you. In addition, we may use the information to customize the content and advertising you see. For example, if you tell us you are interested in cabernets, we may customize the content or advertisements so that you see content and advertisements that are likely to be of more interest to drinkers of Cabernets. By knowing about you, we can deliver more helpful information, programs and tools, and offer you the most relevant services. In addition, we may use the information we collect about you in ways that we specifically describe below or that we describe at the time we collect the information.
(A) Registration. At the time you register as a member of the Services, we may collect your name, address, email address, zip code and other information. Registering allows you to create a personalized feed, use personalized features, tools and content and otherwise use features made available only to registered users; build a profile; create and join groups; and participate in online discussions.
(B) Registration as a Winery or Wine seller: You may register with us to list your wine store or winery, and if you do, we collect certain information about you and your business. We may use this information to incorporate your business into our directory of wineries and wine sellers and to link our users to your online store.
(C) Registration as a blogger. Similarly, you can request that we aggregate your blog through the Services, and if you do, we collect information about you and your blog. When you register as a blogger, we may incorporate your blog into our aggregation services and make all or parts of your blog available to others through the Services. We may use the personal information you give us to identify you as the source or otherwise give you attribution.
(D) Newsletters. At various places on the Services, you will be given the option to receive recurring informational newsletters and to set alerts and reminders. You can unsubscribe from newsletters by clicking on the "unsubscribe" link at the bottom of any newsletter and by changing your settings on your account page which can be accessed by clicking on your username when you are logged in.
(E) Your interactions with the Services while you are logged in. When you are logged in, you will have the opportunity to interact with various parts of the Services. For example, in order to personalize the feed you receive, you tell us about the wines, regions or other wine-related interests you want to follow. You may click on the
icon to tell us that you love a particular wine or post. You can post comments on the Services. We may record the interactions and use the information as described in the first paragraph of this Section 1.
(F) The Buy Icon. Throughout the Services, you will see a
icon. With this icon, we connect you with various online wine sellers. Please be aware that when you link to an online wineseller you are leaving our site and the wineseller's privacy policy - and not this one - govern the collection and use of any information you provide to them.
(G) A Special Word About Posts You Make. Please be aware that any time you make a post to the Site, the information in the post will be available to the public. Once posted, that information will not receive the protections offered by this Privacy Policy to your other personal information. When you are logged in, each of your posts will contain a "delete" link that will be visible to only you. You may use this link to remove posts you no longer wish to be seen on the Site.
(H) Cookies: We and our advertisers collect anonymous information about your use of the Site through cookies. The cookie does not tell us who you are unless you are logged in.
(i) Administrative Purposes. We use cookies to statistically monitor how many people are using our Services, for what purpose and to improve the quality of the Services. For contests or sweepstakes, we may use cookies in order to track your progress and the number of entries in some promotions. For polls, we may use cookies to help ensure that an individual can't vote more than once on a particular question or issue. We do not store any identifying information in any cookies on your computer.
(ii) Advertising delivered by us. The information collected by cookies allows us to tailor advertisements so that you will see advertisements for products and services that you are more likely to have an interest in. For example, if you have been reading a substantial number of posts about Napa Valley wines, we are more likely to deliver advertisements about Napa Valley wines or wineries. We or a company acting on our behalf may place or recognize a unique cookie on your browser in order to control the sequence of advertisements you see and to make sure you don't see the same ad too many times.
(iii) Advertising delivered by third parties. We also have agreements with companies, sometimes called "Ad Networks," that serve advertising on behalf of third parties. These Ad Networks may place or recognize a unique cookie, sometimes called a "third party cookie," on your browser. Ad Networks use cookies to understand Web usage patterns of people who see advertisements, to control the sequence of advertisements you see, to provide you with the most relevant advertising, and to make sure you don't see the same ad too many times. Ad Networks may connect information about pages you visited on our site with information about pages you visit on other sites and show you advertising based on this combined information. While we do not control Ad Networks or what they do with the information they collect, we have relationships only with organizations that have agreed to participate in the Network Advertising Initiative (NAI) and abide by NAI principles, which prohibit members from connecting personally identifiable information to information they collect through cookies without your explicit consent. If you wish to opt out of participating in advertising programs conducted by Ad Networks, please go to the NAI Opt-Out site and follow the instructions on that site.
(iv) Disabling Cookies. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them). Persistent Cookies can be removed by following Internet browser help file directions. If you choose to disable Cookies, some areas of our website may not work properly.
(I) Opinions and polls: Occasionally, you may be asked to give your opinion when you visit the Services. We use information from opinion polls to better understand the needs of our users and to gather information about wine-related trends and issues. Unless otherwise indicated, questions and answers are stored, but they are not linked to identifying information about you and will not be shared with third parties.
(J) Contests and sweepstakes: When you enter a contest or sweepstakes sponsored by booquet and/or one of our partners, we may ask you to provide additional information or answer certain questions in order to participate in a promotion. We may contact you in connection with a particular contest or sweepstakes in order to update you regarding your status, administer the promotion, let you know that a promotion has ended, and for other prize fulfillment needs or contest and sweepstakes related messages.
(K) Search: When you search on our Site or Services, we store the search terms and the site(s) visited so that we can continuously improve the quality of our search results. We do not store your search queries on a personal basis.
(L) Special note for parents: This site is directed for people who are interested in learning about wine and is not intended to attract children younger than 13. We do not collect personal information from any person we actually know is younger than 18.
(M) Log information: When you visit our site, our servers will automatically collect log information. This information may include your Web page request, Internet Protocol (IP) address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser. We collect log information so that we can properly administer our system and gather aggregate information about how our site is being used, including the pages visitors are viewing. We may also use your IP address or similar id used in mobile devices to determine your approximate geographic location in order to provide you with location-relevant advertising.
(N) Research; Aggregated and Anonymous Information. Based on the personal and non-personal information we collect about you, we may look for and analyze usage patterns and trends. We may do this research on our own behalf to improve our services. We may also do this research on behalf of third parties who pay us a fee, including wineries, distributors or retailers. In all cases, however, the results of the research made available to third parties is stripped of your personal information.
(O) Feedback. If you provide feedback on the Site or Services, we may use such feedback for any purpose. We will collect any personal information contained in the communication in accordance with this Privacy Policy.
2. INFORMATION GATHERED FROM THIRD PARTIES.
(A) Friends who help us authenticate you. You can use your Twitter and/or Facebook account in order to log in to your account on booquet. When you do this, we receive your Twitter or Facebook username as well as you email address. We use this information in conformance with this privacy policy.
(B) Co-branded and Marketing Partners. We may receive personal and/or non-personal information about you from our co-branded or marketing partners. Where reasonable, we will let you know what specific information we receive from each such partner. We may add this information to the information we have already collected from you and will use the information in conformance with this policy or as disclosed within the applicable Service.
(C) Demographic Information. We may use your personal information to obtain additional information about you or people in your neighborhood. For example, we may gather information about you or people who live within your 9-digit ZIP code (ZIP+4). The information can include household income, presence and age(s) of children, presence and age(s) of elderly parents, size and value of dwellings, and other census data. We will use this information, combined with information you provide to us and information collected by our systems, to better understand the characteristics of the visitors to our site and to develop new products, services and content areas. The information will also allow us to tailor content, advertising and offers to your interests and needs.
When we associate information that we obtain from third parties with personal information that we have collected under this policy, we will treat the acquired information like the information that we collected ourselves.
3. INFORMATION DISCLOSURE TO THIRD PARTIES.
We know how important it is to keep the information you've entrusted to us confidential. We will not rent, sell or share personal information about you with third parties except to provide you with a product or service you request or under certain circumstances as described below. In all other cases, we will ask for your permission before we disclose your personal information.
(A) Our Social Network Partners: When you make a post to the Services, you may be provided with the opportunity to also make the post available through your Facebook and/or Twitter account. If you make such a request, we will disclose the information to Twitter and/or Facebook and they in turn may make the post available through their services.
(B) Disclosure for legal reasons: We may release personal information to third parties: (i) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (ii) in special cases, such as a physical threat to you or others, a threat to homeland security, a threat to our system or network, or cases in which we believe it is reasonably necessary to investigate or prevent harm, fraud, abuse, or illegal conduct. In the event that we are legally compelled to disclose your personal information to a third party, we will make reasonable efforts to notify you unless doing so would violate the law or court order.
(C) Contractors. Contractors sometimes have access to your personal information in the course of assisting us in operating our business and providing services to you. These contractors include vendors and suppliers that provide us with technology, services, and/or content for the operation and maintenance of our site. Contractors have an obligation under their contracts with us to keep your information confidential and to use the information solely for the purpose of assisting us in providing services to you.
(D) Co-branded Sites. We may have relationships with companies that co-brand their site, or portions of their site (or ours) in order to provide services to you. Co-branded sites may have their own privacy policies. If you visit a co-branded site, please read the privacy policy that is posted on that site as that privacy policy will govern the use of your information.
(E) Aggregated, non-personal information: We may share aggregated information about you with third parties. This is information that is combined with the non-personal information of other users and does not allow you to be identified or contacted. Depending on the circumstances, we may or may not charge third parties for this aggregated information.
(F) Contests and sweepstakes: Some or all of the information collected during a content or sweepstakes may be disclosed publicly. It may also be shared with a co-sponsor(s) or a provider(s) of prizes in order to update you of your status, administer the promotion, let you know that a promotion has ended or for other prize fulfillment needs as indicated on the entry form. If data will be disclosed or shared, we will include a notice at the time of data collection.
(G) Corporate structure:
(i) Affiliates. Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, "Affiliates"), we may in the future. We may share some or all of your information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy. If another company acquires our company or our assets, that company will possess the information collected by it and us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.
(ii) Sale; Merger. If all or part of our company is sold, merged or otherwise transferred to another entity, the personal information you have provided may be transferred as part of that transaction. We will take steps to ensure that, without your consent, any personal information that is transferred will not be used or shared in a manner inconsistent with the Privacy Policy under which it was collected.
4. YOUR CHOICES REGARDING YOUR PERSONAL INFORMATION
4.1 Choices. We offer you choices regarding the collection, use, and sharing of your personal information. We will periodically send you free newsletters and e-mails that directly promote the use of our Site or Services and may contain advertisements for third party companies. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the e-mail you receive and by changing your settings on your account page which can be accessed by clicking on your username when you are logged in. Should you decide to opt-out of receiving future mailings, we may share your e-mail address with third parties to ensure that you do not receive further communications from third parties. Despite your indicated e-mail preferences, we may send you notices of any updates to our Terms of Use, Privacy Policy or other service related issues.
4.2 Changing and deleting your personal information. You may change some of your Personal Information in your account by changing your settings on your account page which can be accessed by clicking on your username when you are logged in. When at your account page, you may also request deletion of the information in your profile, which will cause us to delete from our production database. We may, however, retain some of your information as required by law or our data retention policies and that some of your information may remain in our archives. Please also note that deleting your information through your account page will not delete posts made to the Site or Services. Those must be deleted as set forth in Section 1(d) above.
5. SECURITY OF YOUR PERSONAL INFORMATION.
We are committed to protecting the security of your personal information. We use a variety of industry-standard security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized people. Despite these measures, and as indicated in our Terms of Service, you should know that we cannot fully eliminate security risks associated with your personal information and mistakes may happen.

7. Changes to this policy.
We may update this policy. We will notify you about substantial changes in the way we treat personal information by sending a notice to the email address specified in your account. We may also make nonmaterial changes to our Policy that generally will not affect our use of your personal information. If you don't agree with the new policy, you always have the option of deleting the information in your profile which will in effect close your account. Please see instructions for deleting your personal information above. Our current policy, identified by its effective date, will be posted on the Site, and you should check it frequently.
